1. Agreement to Terms
By accessing or using Smart Tech World's website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
Smart Tech World provides AI chatbot development, business automation, CRM implementation, web development, analytics, and digital marketing services. The specific scope, timeline, and deliverables for each engagement are defined in individual project agreements.
3. Intellectual Property
Upon full payment, you own the deliverables we create specifically for your project. Smart Tech World retains ownership of pre-existing tools, frameworks, and methodologies used in delivery. We may reference your project in our portfolio unless you request otherwise in writing.
4. Payment Terms
Payment terms are defined in individual project agreements. Standard terms require a deposit before work commences. All fees are non-refundable once work has begun unless otherwise specified in your project agreement. Invoices are due within 14 days of issue.
5. Confidentiality
We treat all client information as confidential. We will not disclose your proprietary business information, data, or trade secrets to third parties without your express written consent, except where required by law.
6. Limitation of Liability
Smart Tech World's total liability to you for any claim arising from our services shall not exceed the total fees paid by you in the 3 months preceding the claim. We are not liable for indirect, consequential, or special damages.
7. Warranties
We warrant that our services will be performed with reasonable skill and care. We do not warrant that AI systems will produce 100% accurate results, as AI technology has inherent limitations. We will work to resolve any material defects in our deliverables.
8. Termination
Either party may terminate a project engagement with 30 days written notice. Upon termination, you are responsible for fees for work completed to date. We will provide all completed work and documentation upon receipt of outstanding payments.
9. Governing Law
These Terms of Service are governed by the laws of the State of California, United States. Any disputes shall be resolved through good-faith negotiation, followed by mediation if necessary.
10. Changes to Terms
We reserve the right to update these Terms of Service. We will notify you of material changes via email or prominent notice on our website. Continued use of our services after changes constitutes acceptance of the updated terms.
